dc.description.abstract[eng] This study examines the problem of subjectivism in judicial interpretation through an analysis of decisions rendered by the Brazilian higher courts. It begins by examining leading cases in order to identify manifestations of implicit morality within the judicial decision-making process. It then reconstructs the methodological framework of legal decision-making from a hermeneutic perspective, with particular emphasis on the metarules of subsumption and legal argumentation. Finally, it investigates the philosophical grounds that may account for departures from this framework, highlighting the role of ideology and the interpreter’s pre-understandings. The study concludes that the absence of hermeneutic constraints facilitates the influence of subjective elements in judicial decision-making, thereby undermining the predictability and reviewability of judicial decisions.pt_BR
